Terms and Conditions

Welcome to Ace. These Terms of Service ("Terms") are a legal agreement between you and The Bold Apps, LLC ("Ace", "we", "us", or "our"), the company that operates the Ace mobile and web applications, websites, and related services (together, the "Service"). By creating an account, downloading our app, or using the Service in any way, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
1. Eligibility and Age
You may use Ace only if you can form a binding contract with us under applicable law. You must be at least 13 years old to use the Service. If you live in the European Economic Area, the United Kingdom, or Switzerland, you must be at least 16 years old. If you are a minor in your jurisdiction, you must have permission from a parent or legal guardian, and they must agree to these Terms on your behalf.
We may refuse service, close accounts, or change eligibility requirements at any time.
2. License Grant
Subject to your compliance with these Terms, Ace grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download, install, and use the Service for your personal, non-commercial use on a device you own or control. The Service is licensed, not sold, to you.
3. License Restrictions
Except as expressly permitted by applicable law or by us in writing, you shall not:
- Copy the Service, except as expressly permitted by this license.
- Modify, translate, adapt, or create derivative works or improvements of the Service, whether or not patentable.
- Reverse engineer, disassemble, decompile, decode, or otherwise attempt to derive or gain access to the source code of the Service or any part of it.
- Remove, delete, alter, or obscure any trademarks, copyright, patent, or other intellectual property or proprietary rights notices from the Service.
- Rent, lease, lend, sell, sublicense, assign, distribute, publish, transfer, or otherwise make available the Service, or any features or functionality of the Service, to any third party for any reason.
- Use the Service in any manner that could disable, overburden, damage, or impair the Service or interfere with any other party's use of the Service.
- Use any robot, spider, scraper, or other automated means to access, monitor, copy, or extract data from the Service, or bypass any technical or rate-limiting measures.
- Use the Service to develop a competing product, or to train any machine learning or AI model that is not operated by or for Ace.
4. Account Registration
To use most features of the Service you must create an account. You agree to provide accurate, current, and complete information during registration and to keep that information up to date. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account, whether or not you authorized it. You agree to notify us immediately at support@aceplay.app of any unauthorized use of your account or any other security breach.
You may not create an account on behalf of someone else, impersonate another person, create multiple accounts to evade enforcement, or transfer your account to anyone else without our prior written consent.
5. Public Profile and Public Ranking
Ace is, at its core, a social and competitive ranking platform for padel and tennis. Operating fair, transparent rankings requires that certain information about you be public. By creating an account and using the Service, you understand and agree that the following information is public by default and will be visible to other players, indexable by search engines, and may appear in public rankings, leaderboards, marketing materials, social media, press, and other channels:
- Your full name and profile photo.
- Your country and, where you choose to share it, your home club or city.
- Your level, rating, ranking position, and rating history.
- Your match history, including opponents, partners, scores, and results.
- Your win/loss record, achievements, badges, and tournament results.
- The communities and clubs you belong to, and your role in them.
- Your gameplay preferences (such as preferred sport, hand, position, and availability) where you choose to share them.
- Your posts, comments, reactions, and other contributions in public communities.
Where the Service offers visibility settings, you may adjust them, but core competitive identity (name, level, ratings, match results, and achievements) is inherently public so the ranking system can function. If you do not agree to this, do not use the Service. By signing up, you consent to this public processing of your information.
6. In-App Messaging and Player-to-Player Contact
Ace lets players interact with each other directly. This includes direct messages, match invites, comments, reactions, community posts, calendar invites, and other communications between players. You understand and agree that:
- All communications and interactions between players are between those players. Ace is a passive, neutral platform that transmits and stores those interactions for you.
- Ace does not pre-screen messages or other player communications, does not vet other players, and does not control the conduct of users.
- Ace is not responsible for the content, accuracy, legality, or safety of any messages, posts, comments, photos, or other content shared by users.
- Ace is not responsible for any in-person meetings, matches, training sessions, or other interactions arranged through the Service, or for any harm, harassment, injury, loss, or other consequence arising from those interactions.
- You use messaging and player contact features at your own risk. You are solely responsible for your own behavior and decisions, including who you choose to meet, where, and when.
- You should report any objectionable content or abusive behavior using the in-app reporting tools. Reports are reviewed within 24 hours, in line with Apple App Store guidelines.
- Ace may, but is not obligated to, monitor, moderate, remove, or restrict any content or user conduct on the Service.
7. User-Generated Content and License to Ace
"User Content" means anything you upload, submit, post, or otherwise share through the Service, including profile information, photos, videos, posts, comments, reactions, scores, match data, statistics, gameplay preferences, audio, text, and any other content. You retain ownership of your User Content, subject to the license you grant us below.
By making User Content available through the Service, you grant Ace a worldwide, perpetual, irrevocable, royalty-free, fully-paid, transferable, sublicensable (through multiple tiers), and non-exclusive license to host, store, cache, use, display, reproduce, modify, edit, adapt, publish, translate, create derivative works of, distribute, and publicly perform and display your User Content, in any media, format, or channel now known or later invented, for any purpose related to operating, providing, improving, promoting, or marketing Ace and its affiliated services. This includes, without limitation:
- Operating, providing, and improving the Service and its features.
- Producing public rankings, leaderboards, statistics, and aggregated insights.
- Marketing, advertising, and promotional materials, including App Store and Play Store listings, social media, websites, press, and partner channels.
- Showcasing the Service in pitches, fundraising, partner integrations, and case studies.
- Training, developing, evaluating, and improving machine learning, analytics, ranking, and AI features used in or for Ace's own services.
- Creating derivative works such as highlight reels, summaries, translations, statistics, and visualizations.
- Sharing User Content with our service providers, partners, and affiliates as needed to operate the Service.
You represent and warrant that (a) you own your User Content or have all rights, licenses, consents, and permissions necessary to grant the license above, including from any person who appears in or contributed to it, (b) your User Content does not violate these Terms, applicable law, or any third-party right, and (c) Ace's use of your User Content as described in these Terms will not require any payment to you or any third party.
You may delete User Content from your account at any time. Ace will remove it from active areas of the Service within a reasonable time, but the license you granted survives to the extent (i) your User Content has been shared with or copied by other users, (ii) it has already been incorporated into published or distributed marketing or partner materials, (iii) it exists in backup or archival systems, or (iv) it has been used to derive aggregated, statistical, or anonymized data, which Ace may continue to use indefinitely.
We will not sell your personal data. The license above is for operating, promoting, and improving Ace, not for sale of personal data.
8. Acceptable Use and Community Guidelines
Ace has zero tolerance for objectionable content or abusive behavior. You agree not to use the Service, and you agree your User Content will not, directly or indirectly:
- Contain hate speech, harassment, threats, bullying, sexually explicit material, child sexual abuse material, depictions or promotion of violence, self-harm content, or any content that is unlawful, defamatory, fraudulent, or otherwise objectionable.
- Impersonate another person or entity, misrepresent your affiliation with anyone, or create fake accounts.
- Cheat, manipulate ratings or rankings, fix matches, collude with other players to alter results, or submit fake or misleading scores.
- Dox, expose, or share private information about another person without their consent.
- Send unsolicited commercial messages, spam, chain messages, or pyramid or referral schemes.
- Solicit personal data from minors, or otherwise endanger minors.
- Scrape, crawl, harvest, or extract data from the Service, use bots or other automated tools, or interfere with rate limits or access controls.
- Violate the security of any network, account, or system, or attempt to probe, scan, or test the vulnerability of the Service.
- Use the Service to violate any law, regulation, or third-party right.
We may, at our sole discretion and without prior notice, remove any content or restrict, suspend, or terminate any account that we believe violates these Terms or harms the Service or other users.
9. Reporting and Moderation
You can report objectionable content, abusive users, or any other violation of these Terms using the in-app reporting tools or by emailing support@aceplay.app. We aim to review reports within 24 hours, in line with Apple App Store requirements.
You can also block other users. Blocking is bidirectional: neither party will be able to see the other's profile, posts, or activity, and neither will be able to message or interact with the other in the app.
We may, at our sole discretion, remove content, restrict features, suspend accounts, or permanently terminate accounts based on reports, our own monitoring, or any other source. We are not obligated to take any specific action and our decisions are final.
10. Account Termination
We may suspend, restrict, or terminate your account and your access to the Service at any time, with or without notice, for any reason, including (a) suspected violation of these Terms, (b) suspected fraud, abuse, or unsafe behavior, (c) prolonged inactivity, (d) technical or security reasons, or (e) any legal, regulatory, or business reason.
You may delete your account at any time from the in-app settings or by contacting support@aceplay.app. Termination does not entitle you to any refund of fees already paid. Some information may be retained after termination as described in our Privacy Policy, including for legal, security, fraud prevention, dispute resolution, accounting, and legitimate business purposes. Public content (such as match results that involved other players) may remain visible where removing it would distort historical records.
Sections that by their nature should survive termination (including the license you grant us in Section 7, disclaimers, limitation of liability, indemnification, and dispute resolution) will continue to apply.
11. Subscriptions, Payments, and Refunds
Some parts of the Service may be offered as paid features, subscriptions, in-app purchases, or one-time purchases. Where they are offered through Apple App Store or Google Play, billing, renewals, cancellations, and refunds are handled by those stores under their own terms. Ace does not process those payments directly and cannot issue refunds for App Store or Play Store purchases.
Where Ace processes payments directly (for example, via Stripe), the applicable pricing, billing cycle, taxes, and refund policy will be presented to you at the point of purchase. We may change pricing, introduce new fees, or modify paid features at any time, with reasonable notice for any subscription you have already started. Continued use of a paid feature after a price change becomes effective means you accept the new price.
You are responsible for any taxes, currency conversion fees, or charges imposed by your bank or payment provider.
12. Third-Party Services
The Service integrates with third-party services to operate, including (without limitation) Apple, Google, Stripe, OneSignal, Meta, AppsFlyer, Firebase, and Supabase, as well as other providers we may use from time to time. Your use of those services is also governed by their own terms and privacy policies. Ace is not responsible for the availability, performance, content, security, or privacy practices of any third-party service, and providing access to them does not mean we endorse them.
We may share information with third parties as described in our Privacy Policy, including with partners for advertising, analytics, hosting, push notifications, fraud prevention, and the operation of the Service.
13. Updates to the App and the Service
We are continuously improving Ace. We may, at any time and without prior notice, add, remove, change, suspend, or discontinue any feature, content, or part of the Service. We have no obligation to maintain any particular feature, support any particular device or operating system version, or keep any specific content available.
We may release updates that download and install automatically, and we may require you to install updates to continue using the Service, including for security, compatibility, or legal reasons. You consent to receiving these updates.
14. Intellectual Property
Ace, the Ace name and logo, the Service, all related software, designs, graphics, text, trademarks, service marks, trade dress, and all other content provided by us are owned by The Bold Apps, LLC or its licensors and are protected by intellectual property and other laws. These Terms grant you a license to use the Service, not any ownership rights. All rights not expressly granted to you are reserved.
You may not use our trademarks, branding, or other proprietary materials without our prior written permission. Feedback, suggestions, or ideas you submit to us are non-confidential, and we may use them for any purpose without compensation to you.
If you believe content on the Service infringes your copyright, contact support@aceplay.app with sufficient detail for us to identify and review the content.
15. Disclaimer of Warranties
The Service is provided "as is" and "as available", with all faults and without warranty of any kind. To the maximum extent permitted by applicable law, Ace and its affiliates, officers, directors, employees, agents, suppliers, and licensors expressly disclaim all warranties, whether express, implied, statutory, or otherwise, including any warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, reliability, security, and quiet enjoyment. We do not warrant that the Service will be uninterrupted, error-free, secure, free of viruses or harmful components, or that any defects will be corrected. We do not warrant any results from the Service, including ratings, rankings, statistics, predictions, recommendations, or matches with other players.
Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you. In that case, those warranties are limited to the minimum scope and duration permitted by law.
16. Limitation of Liability
To the fullest extent permitted by applicable law, in no event will Ace, The Bold Apps, LLC, or our affiliates, officers, directors, employees, agents, suppliers, or licensors be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, business, opportunity, or business interruption, arising out of or related to your use of or inability to use the Service, any content on the Service, any conduct or content of other users (including any in-person meeting, match, harassment, injury, or other consequence of player-to-player contact), or any third-party service, even if we have been advised of the possibility of such damages.
To the fullest extent permitted by applicable law, the total aggregate liability of Ace and the parties listed above for all claims arising out of or relating to the Service or these Terms will not exceed the greater of (a) one hundred U.S. dollars ($100) or (b) the total amounts you paid to Ace for the Service in the twelve (12) months immediately before the event giving rise to the claim.
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you. In that case, our liability is limited to the minimum extent permitted by law. Nothing in these Terms limits any liability that cannot be limited under applicable law, including liability for gross negligence, willful misconduct, fraud, or, where applicable, death or personal injury caused by negligence.
17. Indemnification
To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Ace, The Bold Apps, LLC, and our affiliates, officers, directors, employees, agents, suppliers, and licensors from and against any and all claims, demands, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your User Content, (b) your use of or interaction with the Service, (c) your contact, communication, or in-person meeting with other players, (d) your violation of these Terms, applicable law, or any third-party right, or (e) any dispute between you and another user. We reserve the right, at our own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which case you will cooperate in asserting any available defenses.
18. Governing Law and Dispute Resolution
These Terms and any dispute or claim arising out of or related to them or the Service are governed by the laws of the State of Delaware, USA, without regard to its conflict of laws principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
EU, UK, and Switzerland users. If you are a consumer resident in the European Economic Area, the United Kingdom, or Switzerland, nothing in these Terms removes any mandatory consumer protection rights you have under the law of your country of residence, and you may also bring proceedings in the courts of that country. Where local mandatory law conflicts with these Terms, that local mandatory law prevails.
U.S. users: binding individual arbitration; class action waiver. If you are a resident of the United States, you and Ace agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service that cannot be resolved informally will be resolved by binding individual arbitration administered in Delaware under the rules of the American Arbitration Association, instead of in court, except that either party may (i) bring an individual claim in small claims court if it qualifies, and (ii) bring an action in court to protect intellectual property rights. You and Ace waive any right to a jury trial and to participate in any class, collective, consolidated, or representative action. The arbitrator may award only individual relief and may not award relief to any non-party. If this class-action waiver is found unenforceable, the unenforceable portion will be severed and the remainder of this section will continue to apply, but in that case the dispute will proceed in the courts of Delaware. You may opt out of this arbitration agreement by sending written notice to support@aceplay.app within 30 days of first accepting these Terms.
19. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will notify you through an in-app notice, by email, or by other reasonable means before the changes take effect. The updated Terms will be effective on the date stated at the top of this page. Your continued use of the Service after the effective date means you accept the updated Terms. If you do not agree, you must stop using the Service and may delete your account.
20. Severability and Entire Agreement
If any provision of these Terms is held invalid, illegal, or unenforceable, that provision will be modified to the minimum extent necessary, or severed, and the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision is not a waiver of that right or provision. You may not assign or transfer these Terms or your account without our prior written consent. We may assign these Terms at any time without notice.
These Terms, together with our Privacy Policy and any additional terms presented to you in connection with specific features, constitute the entire agreement between you and Ace regarding the Service and supersede all prior agreements and understandings on that subject.
